Terms of Service

Operator: K&E Studios (“we”, “us”)

By accessing or using Castingiron you agree to these Terms. If you use the service on behalf of an organization, you represent that you have authority to bind that organization.

1. The service

Castingiron is an AI-assisted platform for generating UGC-style video and related creative assets, including web app, API, and MCP access. Features may change during public beta. We may modify, suspend, or discontinue parts of the service with reasonable notice when practicable.

2. Accounts

• You must provide accurate account information and keep credentials secure.
• You are responsible for activity under your account and API keys.
• You must be at least 16 years old (or the age of digital consent in your jurisdiction).

3. Tokens, billing & refunds

• Generation is metered in tokens. Unless we publish otherwise: 1 token = $0.10; a standard directed ad costs 25 tokens; a premium ad costs 40 tokens. Partner model clips are priced per catalog entry.
• New accounts may receive a one-time welcome grant (currently 50 tokens) at our discretion.
• Token packs are prepaid and generally non-refundable once purchased, except where required by law or where we automatically refund failed renders.
• Failed paid renders that we mark as failed are refunded to your token balance automatically.
• Payments are processed by Stripe. Taxes may apply.

4. Acceptable use

You will not use Castingiron to:

• Violate law, or the rights of others (including IP, privacy, and publicity rights).
• Generate illegal, harmful, fraudulent, or deceptive content; non-consensual intimate imagery; or content that exploits minors.
• Impersonate real people in a deceptive way without rights/consent required by law.
• Attempt to reverse engineer, disrupt, or overload the service, or bypass rate limits or billing.
• Resell raw access in a way that circumvents our pricing without a written agreement.

We may suspend or terminate accounts that violate these rules.

5. Your content & outputs

• You retain rights in content you submit, subject to the licenses below.
• You grant us a worldwide, non-exclusive license to host, process, and transmit your content solely to provide and improve the service.
• Subject to third-party model provider terms and applicable law, we assign to you (or license you under the same terms we receive) rights in generated outputs produced for your account — provided your use of inputs and outputs is lawful and does not infringe others.
• You are responsible for reviewing outputs before publishing (including claims, compliance, and brand safety). Compliance tooling is assistive, not legal advice.

6. Intellectual property

Castingiron, FORGE-1, our branding, software, and documentation are owned by us or our licensors. These Terms do not grant you rights to our trademarks except as needed to truthfully refer to the service.

7. API & MCP

API keys are confidential. You must not share them publicly. We may rate-limit, revoke keys, or change endpoints with notice when practicable. Public beta APIs may change.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” DURING BETA, OUTPUTS MAY BE INACCURATE, DELAYED, OR UNAVAILABLE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR TOKENS IN THE 3 MONTHS BEFORE THE CLAIM OR (B) $100 USD.

10. Indemnity

You will defend and indemnify us against claims arising from your content, your use of outputs, or your violation of these Terms or law.

11. Termination

You may stop using the service at any time. We may suspend or terminate access for breach, risk, or extended inactivity. Provisions that by nature should survive (including IP, disclaimers, liability limits) will survive termination.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory local consumer law requires otherwise. Courts in Delaware will have exclusive jurisdiction for disputes, subject to applicable consumer protections.

13. Changes

We may update these Terms. Continued use after the effective date constitutes acceptance of the updated Terms, except where notice or consent is required by law.
